Motorist seeks damages over rear-ended collision in Mendota

FRESNO – A woman alleges she was injured when her vehicle was rear-ended at an intersection in Mendota.

Cristina Lorena Ocegueda filed a complaint on Nov. 20 in the Fresno County Superior Court against Esmeralda Joelisa Gonzalez Garcia, Erma Garcia and Does 1-25 alleging negligence.

According to the complaint, on Feb. 28, 2017, the plaintiff was stopped for a red light on Bass Avenue at the intersection of Highway 33 in Mendota when Esmeralda Joelisa Gonzalez Garcia struck the rear of her vehicle.

As a result of the collision, the plaintiff alleges she sustained injuries to her health, strength, activities and shock and injury her nervous system, great mental and physical pain and suffering, medical and related expenses, property damages and loss of earnings. 

The plaintiff holds Esmeralda Joelisa Gonzalez Garcia, Erma Garcia and Does 1-25 responsible because the defendants allegedly failed to adequately maintain and operate a motor vehicle so as not to cause harm, and failed to timely apply breaks.

The plaintiff seeks judgment against defendant for compensatory damages according to proof. She is represented by Ron Torem of Torem & Associates in Beverly Hills.
