Damages sought from driver over rear-end collision on state Route 41 in Fresno

FRESNO – Three individuals are seeking damages from a driver over a rear-end collision in Fresno.

Lauren Vieira, Trisha Vieira and Robert Vieira filed a complaint on Nov. 21 in the Fresno County Superior Court against Richard Gaither and Does 1-20 alleging negligence.

According to the complaint, on Dec. 16, 2016, Lauren Vieira and Trisha Vieira were restrained occupants of a vehicle stopped at a red signal light at state Route 41 at Ashlan Avenue in Fresno when Gaither rear-ended their vehicle. As a result of the accident, the plaintiffs allege they were injured in their health, strength and activity, sustained bodily injury, shock to their nervous systems, and great mental, physical, and nervous pain and suffering.

Plaintiff Robert Vieira alleges he suffered the loss of love, companionship, comfort, care, assistance, affection and society of his wife, Trisha Vieira, as a result of the collision. 

The plaintiffs hold Gaither and Does 1-20 responsible because the Gaither allegedly operated a vehicle at a speed greater than is reasonable or prudent in disregard for the conditions of the highway.

The plaintiffs seek judgment against defendant for compensatory damages according to proof. They are represented by Jeffrey D. Bohn of Accident, Injury & Medical Malpractice Attorneys of California APC in Fresno.
