Wheelchair user files suit against Fresno over allegations chair was not secured while on bus

FRESNO – A wheelchair user alleges her wheelchair was not properly secured on a Fresno bus.

Rosemary Duran filed a complaint on Dec. 4 in the Fresno County Superior Court against the city of Fresno, County of Fresno, and Does 1-50 alleging negligence.

According to the complaint, the plaintiff alleges on Jan. 18, she boarded the Fresno City Bus Line 38 Bus 610 in a wheelchair. She alleges she was assisted and valeted by the bus driver and he failed to properly secure and fasten plaintiff's wheelchair, causing her to be discharged from the wheelchair and suffer severe injuries.

The plaintiff holds the city of Fresno, the county of Fresno, and Does 1-50 responsible because the defendants allegedly failed to secure plaintiff's wheelchair while en-route, failed to ensure plaintiff was properly situated and secured within the bus.

The plaintiff seeks judgment against defendant for compensatory damages according to proof. She is represented by Abraham Dervishian of D&Z Law Group in Glendale.
