SAN FRANCISCO – The landlord of a San Francisco property alleges its tenant vacated the premises and that the guarantors under the agreement are responsible for back rent.
FO 2360 Van Ness Avenue Property LLC filed a complaint on Dec. 6 in the San Francisco Superior Court against Jerrid Wood, Masaye Waugh, Isami Arifuku and Does 1 through 50 alleging breach of contract.
According to the complaint, on June 22, 2015, the plaintiff entered into a commercial rental agreement with Peach Corvette LLC as the tenant for the commercial rental of its Van Ness Avenue, San Francisco property. The suit states this lease was guaranteed by the defendants.
The suit states Peach Corvette vacated the premises on Nov. 30 while owing $40,552.79 in back rent and $132,219.94 for future minimum monthly rent from Dec. 1 through June 30, 2020.
The plaintiff holds Wood, Waugh, Arifuku and Does 1 through 50 responsible because the defendants allegedly are liable for the rent damages.
The plaintiff seeks judgment for general damages in the amount of $201,272.73, attorneys' fees, special damages, costs of suit, and any other relief that the court deems to be just and proper.
