The Infinity Owners Association alleges condo owner failed to pay fees

SAN FRANCISCO – A condominium association alleges a unit owner failed to pay associated costs and fees.

The Infinity Owners Association filed a complaint on Dec. 7 in the San Francisco Superior Court against James Gutierrez and Does 1-20 alleging breach of contract.

According to the complaint, on June 11, 2008, The Infinity Owners Association agreed to grant title to a real property at 338 Spear St. in the Infinity Condominium Project to defendant Gutierrez.

The plaintiff alleges since Jan. 5, 2016, the defendant breached the conditions of the agreement by failing and refusing to pay assessments, late fees and other associated costs and fees.

The plaintiff seeks judgment for damages in the principal sum of $9,608.60, plus attorneys' fees, costs of suit and such further relief as the court deems appropriate. It is represented by Matthew P. Harrington of Hughes Gill Cochrane Tinetti PC in Walnut Creek.
