SAN FRANCISCO – An insurance company is seeking subrogation from a driver for workers' compensation benefits it paid.
Sedgwick Claims Management Services Inc. for Republic Underwriters Insurance Co. filed a complaint on Dec. 7 in the San Francisco Superior Court against John Luck alleging negligence.
According to the complaint, on Dec. 16, 2016, Nursing and Rehab at Home employee Zoey Lam was injured after a vehicle collision with defendant Luck in Daly City.
As a direct proximate result, plaintiff Sedgwick alleges it was obligated to pay workers' compensation benefits.
The plaintiff holds Luck responsible because the defendant allegedly negligently operated the vehicle.
The plaintiff seeks judgment for compensatory damages according to proof. It is represented by Christopher J. Capalbo of Siegel, Moreno & Stettler APC in San Diego.
