Former Mangiare Catering cook alleges he is owed unpaid wages

SAN FRANCISCO – A former employee of a San Francisco restaurant alleges the business failed to pay him a regular wage.

Nemezio Silveira Barros filed a complaint on Dec. 10 in the San Francisco Superior Court against Mangiare Catering LLC, George Hawawini and Does 1-20 alleging violation of California labor codes.

According to the complaint, for two periods between April 2015 and December 2016, Barros worked for the defendants as a non-exempt, hourly employee cook. He alleges he regularly worked more than eight hours per day and six days a week. 

The plaintiff alleges he was not paid the correct wage, denied full, timely uninterrupted meal and/or rest breaks and received pay checks that bounced because of insufficient funds. He also alleges was terminated when he complained about his low pay and long hours. 

The plaintiff holds Mangiare Catering LLC, Hawawini and Does 1-20 responsible because the defendants allegedly failed to pay plaintiff's regular time and overtime pay and failed to provide meal and rest breaks.

The plaintiff requests a trial by jury and seeks judgment for unpaid wages, injunctive relief, costs of suit and for such other and further relief as the court may deem appropriate. He is represented by Mark L. Venardi, Mark Zurada and Mark Freeman of Venardi Zurada LLP in Orinda.
