Former San Francisco condo unit owner alleges leaky window caused nearly $250,000 in damages

SAN FRANCISCO – The former owner of a condominium unit alleges a window in the unit above hers caused water damage to her unit.

Chandra Baird filed a complaint on Dec. 10 in the San Francisco Superior Court against 1080 Chestnut Street Cooperative Home Owners Association, Ron Miller and Does 1 through 10 alleging breach of written contract and other counts.

According to the complaint, in November 2015, Baird entered into contract to sell her condominium unit with escrow scheduled to close on Jan. 6, 2016. The suit states the unit is part of the 1080 Chestnut Street Cooperative.

However, the suit states the buyer declined to go through with the purchase of the premises due to water damage after a storm in December 2015. The suit states a picture window in the penthouse above the plaintiff's unit, which is owned by Miller, was the source of the water intrusion.

The plaintiff holds 1080 Chestnut Street Cooperative Home Owners Association, Miller and Does 1 through 10 responsible because the defendants allegedly failed to inspect, repair and maintain the window in the penthouse.

The plaintiff seeks judgment for the sum of $246,365.75, plus prejudgment interest, consequential damages, attorney's fees, costs of suit and such other and further relief as the court may deem just and proper. She is represented by Michael J. McLaughlin and Robert Peter Weiss of McLaughlin Sanchez LLP in San Francisco.
