Paradise property owner alleges Lucito Insurance Agency failed to reinstate policy before Camp Fire

OROVILLE – A property owner whose Paradise home was destroyed by the Camp Fire alleges an insurance agency failed to reinstate her fire and casualty insurance.

Tait C. Johnson filed a complaint on Dec. 3 in the Butte Superior Court against Lucito Insurance Agency Inc., Julieann Lucito and Does 1 through 10 alleging negligence.

According to the complaint, the plaintiff owns a Paradise property and in April, she requested fire and casualty insurance from the defendants for the dwelling and improvements. The suit states the defendants procured a policy in May effective through April 2019 from Foremost Insurance Co.

The suit states the property was destroyed in the Camp Fire in November and the plaintiff reported the loss to Foremost. The suit states Foremost told her that the defendants never sent requested information needed to reinstate her policy after she had completed needed deck repairs in July.

The plaintiff holds Lucito Insurance Agency Inc., Lucito and Does 1 through 10 responsible because the defendants allegedly represented that they would have the policy reinstated and neglected to do so.

The plaintiff seeks judgment for damages in the sum of $450,000 with interest, cost of suit and for such other and further relief as the court deems proper. She is represented by David R. Griffith of Griffith & Horn LLP in Chico.
