FRESNO – The operator of a Fresno County business alleges funds owed to the business were wrongfully deposited by an ATM operator.
Ajit Gill, doing business as Handi Stop Market, filed a complaint on Dec. 17 in the Fresno County Superior Court against Cardtronics USA Inc., doing business as Kahuna ATM Solutions; Meta Financial Group Inc.; Metabank; Meta Payment Systems and Does 1-25 alleging negligence and other counts.
According to the complaint, in 2015, Handi Stop Market entered into an ATM operator agreement with Kahuna ATM Solutions. The suit states Cardtronics USA later purchased Kahuna.
The plaintiff alleges that in the beginning, the ATM processing was properly performing, however from July 2015 to May 2017, the monies owed to the plaintiff were wrongfully deposited by Cardtronics into a different account and the error wasn't discovered until about March 2018.
Despite demands, the plaintiff alleges he has not received owed monies in the amount of at least $523,000, plus interest in the amount of $108,382 and $4,681 in loans fees HSM was required to pay as a result of not having been paid to by Cardtronics.
The plaintiff alleges the defendants failed to properly disburse, distribute, and/or reimburse the funds related to the processing of HSM's ATM transactions to plaintiff.
The plaintiff requests a trial by jury and seeks judgment for damages, plus interest, costs of suit incurred, attorneys' fees, and for such other and further relief as the court deems just and proper. He is represented by G. Andrew Slater and Justin L. Thomas of Dowling Aaron Inc. in Fresno.
