FRESNO – A dairy products distributor based in Fresno is alleged to have failed to pay invoices due to a Florida pallet company.

iGPS Logistics LLC filed a complaint on Dec. 14 in the Fresno County Superior Court against Quality Fresh Farms Inc. alleging breach of contract and other counts.

According to the complaint, on July 11, the parties entered into a rental agreement wherein plaintiff authorized defendant to use pallets in accordance with the express terms and conditions of the agreement. The suit also states that the agreement outlines for the return of the pallets in the event the agreement is terminated.

The plaintiff alleges the defendant never paid a single invoice and has failed to return more than 3,000 pallets.

The plaintiff holds Quality Fresh Farms Inc. responsible because the defendant allegedly failed to pay any invoices and failed to cure the breaches.

The plaintiff requests a trial by jury and seeks judgment for actual damages, attorneys' fees incurred, costs, expenses, and such other and further relief as the court may deem just and appropriate. They are represented by Kamran Mirrafati and Jessica N. Walker of Foley & Lardner LLP in Los Angeles.
