Ally Bank alleges Butte County residents owe more than $30,000 for loan

OROVILLE – Two Butte County residents are alleged to have defaulted on an auto loan.

Ally Bank filed a complaint on Dec. 10 in the Butte County Superior Court against Hollie Morris, Michael D. Kibby Jr. and Does 1-20 alleging breach of contract and other counts.

According to the complaint, the plaintiff entered into a retail installment sale contract with the defendants for the purchase of a used 2015 Toyota Tacoma in July 2016. The plaintiff alleges the defendants failed to make the monthly payments that became due on May 30.

The plaintiff seeks judgment against defendants in the amount of $32,864.08, plus accruing charges, attorneys’ fees, and other costs and expenses, and further relief as the court may deem just. It is represented by Adam N. Barasch and Donald H. Cram of Severson & Werson APC in San Francisco.
