SAN FRANCISCO – A Michigan corporation alleges a San Francisco company defaulted on payments for equipment.
De Lage Landen Financial Services Inc. filed a complaint on Dec. 15 in the San Francisco County Superior Court against Driver Inc. and Does 1-50 alleging breach of contract.
According to the complaint, the plaintiff alleges that on July 22, 2013, Driver Inc. entered into a master lease agreement with the plaintiff and into master lease schedules in June 2016 and April 2017 for an Illumina NextSeq 500 Sequencing System and all attachments and accessories.
The plaintiff alleges in September, the defendants breached the lease and schedules by failing to pay the monthly payments due. The plaintiff alleges it has been damaged in the amount of $646,701.33 plus interest.
The plaintiff holds Driver Inc. and Does 1-50 responsible because the defendants allegedly failed and refused to make any payments due.
The plaintiff requests a trial by jury and seeks judgment against defendant for unpaid accelerated balances in the amount of $646,701.33, principal sum of $14,401.08, value of equipment in the sum of $254,000, loss of use in the amount of $32,376.67, plus accruing interest, attorneys' fees, costs of suit, attorneys' fees, costs of suit and further relief as the court may deem proper.
