Cupertino Electric alleges Lendlease (US) Construction owes more than $600,000

SAN FRANCISCO – A contractor alleges it wasn't paid for work it performed on a San Francisco project.

Cupertino Electric Inc. filed a complaint on Dec. 13 in the San Francisco Superior Court against Lendlease (US) Construction Inc., Liberty Mutual Insurance Co., Fidelity and Deposit Co. of Maryland; American Home Assurance Co. and Does 1-100 alleging breach of contract and other counts.

According to the complaint, the plaintiff furnished labor and materials pursuant to a written contract with Lendlease on a construction project in San Francisco. The plaintiff alleges it has performed all conditions, covenants and promises required on its part under the contract.

The plaintiff holds Lendlease (US) Construction Inc.; Liberty Mutual Insurance Co.; Fidelity and Deposit Co. of Maryland and American Home Assurance Co. responsible because the defendants allegedly failed to make payment to plaintiff in the amount of $615,758.63.

The plaintiff seeks judgment on the release bond in the amount of $615,758.63, plus costs of suit, attorney's fees, and such other relief as the court may deem just and proper. It is represented by Matthew F. Graham and Garet D. Murai of Wendel, Rosen, Black & Dean LLP in Oakland.
