Former Shift Operations employee alleges disability was factor in termination

SAN FRANCISCO – A former employee of a San Francisco company alleges he was terminated because of his disability.

Ronald Baker filed a complaint on Dec. 20 in the San Francisco Superior Court against Shift Operations LLC, Shift Technologies and Does 1 through 10 over alleged violation of the Labor Code covered by the California Fair Employment Housing Act and California Family Rights Act.

According to the complaint, in February 2016, Baker was hired as full-time car concierge to pick up used cars for defendants. He alleges he regularly worked at least eight hours a day and at least 40 hours a week, often working in excess of hours and often driving several hours in a workday. 

On Dec. 20, 2016, he alleges he submitted a doctor's note to defendants regarding limitations on the amount of driving as a result of a medical condition regarding his back. He alleges the defendants did not schedule him past his last day of work on Dec. 30, 2016.

The plaintiff holds Shift Operations LLC, Shift Technologies and Does 1 through 10 responsible because the defendants allegedly terminated him based on his actual or perceived disability.

The plaintiff seeks judgment for all damages, restitution of all monies, award of interest, attorneys' fees and such other and further relief as the court may deem proper. He is represented by Marvin Dunson III of Law Office of Marvin Dunson III in San Francisco.
