SAN FRANCISCO – A man alleges he was terminated from his position as a senior software engineer because he took family leave.
Calvin Yee filed a complaint on Dec. 19 in the San Francisco County Superior Court against DocuSign Inc., Kiran Kiza and Does 1-5 alleging wrongful termination and other counts.
According to the complaint, the plaintiff was hired by DocuSign as senior software engineer in May 2016. He alleges he took a three-week absence to bond with his infant son and when he returned, he was subjected to unjustified and unwarranted criticisms of his job performance. The suit states he was terminated in October 2018.
The plaintiff holds DocuSign Inc., Kiza and Does 1-50 responsible because the defendants allegedly terminated him because he requested protected family leave authorized by the California Family Rights Act.
The plaintiff requests a trial by jury and seeks judgment against defendant for general, special, actual, compensatory and/or nominal damages; back pay and other benefits; declaratory relief; statutory penalties; costs and expenses; attorneys' fees; interest and other relief as the court deems just.
