Driver alleges he was assaulted by another motorist after collision in San Francisco

SAN FRANCISCO – A man alleges that a driver struck his vehicle and then assaulted him.

Francisco da Silva filed a complaint on Dec. 21 in the San Francisco Superior Court against Hoang Viet Pham alleging negligence.

According to the complaint, on Dec. 24, 2016, da Silva was driving on Jefferson Street between Leavenworth and Jones streets in San Francisco when his vehicle was struck by defendant Pham's vehicle. The suit states the defendant left the scene and the plaintiff followed him to gather information. The plaintiff alleges the defendant berated and assaulted him when he did stop.

The plaintiff holds Pham responsible because the defendant allegedly failed to use reasonable care in operation of his vehicle.

The plaintiff seeks judgment for compensatory and punitive damages, costs of suit and such relief as is fair, just and equitable. He is represented by Nikolaus W. Reed of Law Office of Nikolaus Reed in San Francisco.
