Man alleges escalator at BART station caused him to fall and hit head

SAN FRANCISCO – A man alleges he was injured when an escalator at a San Francisco station stopped and caused him to fall.

Anthony Sheppard filed a complaint on Dec. 19 in the San Francisco County Superior Court against the San Francisco Bay Area Rapid Transit, city and county of San Francisco and Does 1-25 alleging negligence.

According to the complaint, the plaintiff alleges that on June 22, while he was riding the escalator at defendant's Montgomery BART Station, the escalator suddenly stopped, throwing him backward and causing him to hit his head.

The plaintiff holds San Francisco Bay Area Rapid Transit, the city and county of San Francisco and Does 1-25 responsible because the defendants allegedly failed to make the condition safe or warn invitees of the dangerous condition of its facility.

The plaintiff seeks judgment against defendants for compensatory damages, costs of suit and further relief as is fair and just. He is represented by Bradley D. Fell of Golden Gate Law Group in Walnut Creek.
