SAN FRANCISCO – A rider has filed a suit against Uber over allegations she was assaulted by a driver.

Zene Peterson filed a complaint on Dec. 26 in the San Francisco County Superior Court against Uber Technologies Inc., Rasier LLC, Rasier-CA LLC and Does 1-50 alleging assault, battery, negligence and other counts.

According to the complaint, on Jan. 1, 2017, the plaintiff was being transported by the defendants when the driver pulled on her hair, punched her and slammed her against the vehicle. She alleges she was injured in her health and strength and caused mental, physical and nervous pain.

The plaintiff holds Uber Technologies Inc., Rasier LLC, Rasier-CA LLC and Does 1-50 responsible because the defendants allegedly knew or should have known that their driver was a person who engaged in harmful and/or inappropriate behavior and did not take reasonable precautions for her safety and protection.

The plaintiff requests a trial by jury and seeks judgment against defendants for general and punitive damages, medical expenses, lost earnings, interest, costs of suit and further relief as the court deems just. She is represented by Michael Martinovsky of The Law Offices of Michael Martinovsky PC in San Rafael.
