Man files suit against Golden Gate Disposal & Recycling, others after he was crushed by garbage truck

SAN FRANCISCO – A man alleges he sustained multiple injuries when the metal trash bin he was in was picked up by a garbage truck and he was crushed in the truck.

Andres Lopez Pinzon filed a complaint on Dec. 31 in the San Francisco Superior Court against Recology Inc., Golden Gate Disposal & Recycling Co., Sue Mills Inc., John Borzoni and Does 1 to 25 alleging premises liability, negligence and other counts.

According to the complaint, on Feb. 20, 2017, Pinzon was inside a large metal trash bin on the property owned by Sue Mills on Harrison Street in San Francisco that was picked up by a garbage truck driven by Borzoni and owned by Recology Inc. and Golden Gate Disposal & Recycling Co. The suit states the plaintiff was dumped into the garbage truck and crushed. The suit states he was transported to a trash processing facility, dumped into a trash pile, and an employee later discovered him.

As a result, the plaintiff alleges he suffered a ruptured bladder, internal bleeding, fractured ribs, medical expenses and emotional distress. 

The plaintiff holds the defendants responsible because the defendants allegedly failed to see the plaintiff in the bin and/or garbage truck before compacting him and failed to warn of dangerous or unsafe conditions.

The plaintiff seeks judgment for compensatory damages, costs of suit, and such relief as is fair, just, and equitable. He is represented by Eloy I. Trujillo of Eloy I. Trujillo, PC in San Francisco.
