Tom's Metal Specialists alleges it is owed more than $40,000 for work on project

SAN FRANCISCO – A San Francisco County metal fabrication business alleges it was not paid for work it did on a project by a San Mateo County company.

Tom's Metal Specialists Inc. filed a complaint on Dec. 31 in the San Francisco Superior Court against Cannon Constructors North Inc., American Contractors Indemnity Co. and Does 1-25 alleging breach of written contract.

According to the complaint, in 2016, the plaintiff entered into a written subcontract agreement with Cannon Constructors to perform the metal work and related improvement work on a project.

Between 2017 and 2018, the plaintiff alleges it performed all of its work and Cannon has failed to pay it the principal sum of $40,000. The suit states American Contractors Indemnity acted as surety.

The plaintiff requests a trial by jury and seeks judgment in the sum of $40,000 principal, plus interest, attorneys' fees, costs of suit, and such other and further relief as the court deems just and proper. It is represented by William C. Last Jr. and Jonathan M. Bowne of Last & Faoro in San Mateo.
