SAN FRANCISCO – Two Fairfield residents are revoking the acceptance of a sales contract of a Cadillac vehicle they allege has defects.
Fermin P. Maturin and Leticia C. Maturin filed a complaint on Dec. 27 in the San Francisco County Superior Court against General Motors LLC, et al. alleging violation of the Song-Beverly Act.
According to the complaint, the plaintiffs allege that on July 6, 2017, they purchased a new 2016 Cadillac Escapade manufactured and distributed by the defendants. They allege the vehicle was delivered to them with serious defects and nonformities to warranty and it developed other defects and nonformities to warranty, including transmission, engine, electrical, exterior and structural defects.
The plaintiffs allege they delivered the vehicle to an authorized General Motors repair facility and it was unable to conform the vehicle to its warranties after a number of repair attempts. They allege they are entitled to replacement or reimbursement.
The plaintiffs request a trial by jury and seek judgment against defendants for general, special and actual damages; rescission and restitution; diminution; incidental and consequential damages; civil penalty; interest; attorney's fees; costs of suit; and further relief as the court deems just.
