FRESNO – A consumer alleges a General Motors-manufactured vehicle he purchased in 2014 has defects that General Motors has failed to repair.
Eliasar Rios filed a complaint on Jan. 7 in the Fresno County Superior Court against General Motors LLC and Does 1 through 10 over alleged violation of the Song-Beverly Consumer Warranty Act.
According to the complaint, on Dec. 1, 2014, Rios purchased a 2014 Chevrolet Silverado from Hedricks’ Chevrolet in Clovis, which was issued with an express warranty from the defendant. The plaintiff alleges that the vehicle has issues with the transmission, four-wheel drive system, transfer case control module and other issues.
The plaintiff holds General Motors LLC and Does 1 through 10 responsible because the defendant allegedly failed and refused to replace the vehicle or make restitution to plaintiff and failed to commence repairs within a reasonable amount of time or repair the subject vehicle to warranty after a reasonable number of attempts.
The plaintiff seeks judgment for civil penalties up to two times in the amount of $51,528.64, plus attorney’s fees, costs of suit, and such other and further relief as the court deems proper. He is represented by Brian J. Bickel and Stephanie S. Pengilley of The Beckel Law Firm Inc. in San Diego.
