SAN FRANCISCO – A Swords to Plowshares driver is seeking damages from a motorist and a business after she was struck while re-entering her vehicle in San Francisco.

Rosemarie Elumba filed a complaint on Jan. 14 in the San Francisco County Superior Court against C3 Concrete Surface Inc., Bucio Trujillo Santiago and Does 1-20 alleging negligence.

According to the complaint, the plaintiff alleges that on June 28, 2018, while she was working as a driver for Swords to Plowshares, she parked her Honda Odyssey along Second Street in San Francisco to assist a passenger when a truck negligently driven by Santiago struck her as she was attempting to re-enter her vehicle. The suit states Santiago was in the course and scope of his employment with C3 Concrete Surface at the time.

The plaintiff holds C3 Concrete Surface Inc., Bucio Trujillo Santiago and Does 1-20 responsible because Santiago allegedly negligently and carelessly operated the truck and C3 Concrete Surface negligently hired and employed Santiago.

The plaintiff seeks judgment against the defendants for general and special damages, interest, costs of suit and other relief as the court deems proper. She is represented by Thomas J. Brandi and Daniel Dell'Osso of The Brandi Law Firm in San Francisco and Thomas G. Lewellyn of Law Offices of Thomas G. Lewellyn in Alameda.
