State Farm seeks subrogation of nearly $20,000 over San Francisco vehicle collision

SAN FRANCISCO – An insurance company alleges it is entitled to recover nearly $20,000 from two individuals over a San Francisco auto accident.

State Farm Mutual Automobile Insurance Co. filed a complaint on Feb. 1 in the San Francisco Superior Court against Igor Bayandin, Oleyssa Povtar and Does 1-40 seeking subrogation recovery.

According to the complaint, on July 27, 2017, State Farm's insured, Debra Volk, was driving in San Francisco when her vehicle was struck by Bayandin, who was driving a vehicle owned by Povtar.

The plaintiff claims it complied with all terms and conditions under the insured's policy and paid $18,491.13 to Volk. 

The plaintiff alleges it is entitled to its right of subrogation to recover the said amounts plus interest from defendants. It alleges the defendants have failed and refused to pay the amount.

The plaintiff seeks judgment for the sum of $18,491.13, plus prejudgment interest, costs of suit, and such other and further relief as the court may deem just and proper. It is represented by Richard L. Mahfouz II and Molly E. Hoot of Clerkin, Sinclair & Mahfouz LLP in San Diego.
