Ziel Equipment, Sales and Service alleges Greenbroz, Purogen brochure damaged reputation

SAN FRANCISCO – A company with its principal place of business in San Francisco County alleges a brochure was published by a competitor that contained false statements about its product.

Ziel Equipment, Sales and Services LLC filed a complaint on Feb. 5 in the San Francisco Superior Court against Greenbroz Inc., Purogen Laboratories LLC and Does 1-25 alleging trade libel and other counts.

According to the complaint, the plaintiff sells a product known as Apex, which uses a radio frequency to kill pathogens and microbial organisms on cannabis and other crops. The suit states Greenbroz is a competitor of the plaintiff and sells a product similar to Apex it calls TheBOX, which is manufactured by Purogen.

In 2018, Ziel alleges it discovered that a marketing brochure was being transmitted by defendants to its potential customers that compares TheBOX, Apex and other product. The plaintiff alleges that the brochure contains false information about Apex and that its reputation has been damaged by the false information.

The plaintiff holds Greenbroz Inc., Purogen Laboratories LLC and Does 1-25 responsible because the defendants allegedly distributed the brochure with the intent to increase sales of TheBox and decrease sales of Apex.

The plaintiff requests a trial by jury and seeks award of general, special, compensatory, and/or punitive damages; injunctive relief; attorneys' fees; costs; and such other relief as the court may deem just and proper. It is represented by Adrian J. Webber of Downey Brand LLP in Sacramento.
