SAN FRANCISCO – A cyclist and his wife have filed suit against a driver over a rear-end collision in San Francisco.
Stephen K. Marks and Laura L. Marks filed a complaint on Feb. 4 in the San Francisco Superior Court against Eric D. Aguileraacevedo, Robert Ballard and Does 1-50 alleging negligence and loss of consortium.
According to the complaint, on May 9, 2018, Stephen Marks was operating a Hai All Mountain 8.0 electric bicycle and was stopped at a traffic light at The Embarcadero and Stockton Street in San Francisco. The suit states defendant Aguilaraacevedo struck the plaintiff while driving a 2010 Ford Edge.
As a result, the suit states Stephen K. Marks sustained severe injuries and his wife, Laura K. Marks, alleges she has lost the comfort, care, society and martial relationship of her husband.
The plaintiffs hold Aguileraacevedo, Ballard and Does 1-50 responsible because Aguileraacevedo allegedly drove at an excessive speed for the condition and followed plaintiff's bicycle too closely.
The plaintiffs request a trial by jury and seek judgment for general and special damages, costs of suit, prejudgment interest, and for such other and further relief the court deems just and proper. They are represented by Robert B. Abel Jr. of Law Offices of Robert B. Abel Jr. in San Francisco.
