OROVILLE – A consumer alleges a Ford Mustang he purchased as a defective clutch and is seeking restitution.

Steven Fletcher filed a complaint on Feb. 7 in the Butte Superior Court against Ford Motor Co. Inc. alleging breach of express written warranty, violation of the Magnuson-Moss Warranty Act and other counts.

According to the complaint, on March 23, 2016, Fletcher purchased a 2016 Ford Mustang manufactured and or distributed by defendant and he received an express written warranty.

He alleges during the warranty period, the vehicle developed defects in the engine, electrical system, transmission and clutch and the defendant and its representatives have been unable to repair the vehicle to conform with the warranty.

The plaintiff holds Ford Motor Co. Inc. responsible because the defendant allegedly violated the Magnuson-Moss Warranty Act by failing to repair the defects or replace the vehicle.

The plaintiff requests a trial by jury and seeks judgment for actual damages, restitution, costs of suit, prejudgment interest and for such other relief as the court may deem proper. He is represented by Patrea R. Bullock in Roseville.
