County of Butte seeks compensation benefits from driver it paid to employee over collision

OROVILLE – The County of Butte is seeking damages from a motorist over a collision that injured one of its employees in the county.

County of Butte by York Risk Services Group filed a complaint on Feb. 8 in the Butte Superior Court against Michaela Noel Smith and Does 1-50 alleging general negligence.

According to the complaint, on Feb. 20, 2017, Smith was operating a vehicle on state Route 99 near its intersection with Entler Avenue in Butte County when she collided with a truck owned by Butte County and operated by its employee, Brett James Cambra.

The suit states Cambra filed a claim for workers' compensation benefits and the County of Butte through York Risk Services Group paid benefits. The plaintiff alleges it is now entitled to all sums due and owing to Cambra.

The plaintiff seek judgment for compensation benefits, plus interest, costs of suit, attorney's fees and for such other and further relief as the court may deem proper. It is represented by Medy F. Beauchane of Mullen & Filippi LLP in Chico.
