Tahoe driver alleges vehicle was rear-ended in Fresno by impaired driver

FRESNO – A motorist alleges he was rear-ended by an impaired driver in Fresno and injured.

Zachary Griffith filed a complaint on Feb. 4 in the Fresno County Superior Court against Eric Martinez-Hernandez, Enrique Martinez Jr. and Does 1-25 alleging negligence and negligent entrustment.

According to the complaint, the plaintiff alleges that on March 3, 2017, Martinez Jr. negligently entrusted a 2009 Lexus IS250 to Martinez-Hernandez, whose abilities were impaired by the consumption of alcohol.

The suit states Martinez-Hernandez collided with the rear bumper of plaintiff's 1997 Chevrolet Tahoe, causing the plaintiff's vehicle to propel forward and strike a 2016 Ducati Monster motorcycle on Highway 180 near Highway 99 in Fresno. As a result, the plaintiff alleges he sustained injuries and damages.

The plaintiff holds Martinez-Hernandez, Martinez Jr. and Does 1-25 responsible because Martinez-Hernandez allegedly operated the vehicle after consuming alcohol and Martinez Jr. negligently entrusted the vehicle to him.

The plaintiff seeks judgment against the defendants for costs of suit, compensatory and punitive damages and other relief the court deems just. He is represented by Michael W. Berdinella of Law Offices of Michael W. Berdinella in Fresno.
