CPR class proves dangerous for San Jose man, who sues instruction company after his hand is injured

REDWOOD CITY - A San Jose man just hoping to learn how to save lives sued a CPR instruction company after he was injured during a CPR demonstration, according to documents filed on Feb. 11 in the San Mateo County Superior Court. 

Plaintiff Brian Fernando went to a CPR class held by defendant In Home CPR in December 2019. Fernando was performing chest compressions on a mannequin when an In Home employee allegedly placed his hands over Fernando's and began forcibly pressing down with his full body weight as a compression demonstration. 

Fernando allegedly experienced severe pain and swelling in the days following the demonstration, and eventually visited the emergency room where he was diagnosed with a scapholunate dissociation, an injury of a ligament in the hand, and put into a cast. Full function of the hand will likely never be recovered, he says.

In Home CPR is sued with one count of negligence and one count of breach of duty. Fernando seeks compensatory damages, lost wages, medical fees and litigation expenses. He is represented by David Ratner of Ratner Molineaux LLP.
