Lawsuit filed against Mountain View PD after alleged police dog attack in wrong house

SAN JOSE - An arrest in June of 2020 that allegedly included excessive force, assault, and battery from the officers has resulted in civil charges against the City of Palo Alto, the City of Mountain View, a law enforcement officer and 50 unidentified others. 

According to documents filed on March 15 in the Santa Clara County Superior Court, police raided the home of plaintiff Joel Alejo of Mountain View on June 25, 2020. During the raid, defendant Officer Green allegedly released a K9 on Alejo to apprehend him; the plaintiff sustained multiple serious dog bite wounds as a result. 

Following the raid, the Mountain View Police Department found they had raided the wrong house, and Alejo was an innocent person, the suit says.

Despite this error and the serious injuries that Alejo endured according to the suit, the defendants rejected his claim for injuries in August 2020.

The defendants are charged with use of excessive force, due process violation, denial of equal protection and due process of law, threats, intimidation or coercion, violation of statutory duty, negligence, assault and battery, false imprisonment and intentional and negligent infliction of emotional distress.
