SAN JOSE - A man shot by officers from the San Jose Police Department in June 2020 brought the department and officers to federal court in the Northern California District to answer for the incident.
According to a lawsuit filed on April 6, plaintiff Yuridia Ochoa was doing "donuts," or burning out her car's tires in circles, in the middle of an intersection at about 9 p.m. on June 2, 2020. Ochoa fled the San Jose Police Department when police vehicles attempted to pull her over.
Ochoa struck a woman on a scooter, injuring her, and continued fleeing. Ochoa was eventually cornered in a parking lot and did not abide to police commands, the suit says. Despite police ordering Ochoa turn the car off, Ochoa's vehicle began to move in reverse, the suit says.
Defendant police officer Eric Mosunic shot Ochoa a total of 14 times as she continued to move the vehicle in reverse despite officer commands, the suit says.
Ochoa sues the defendants for excessive force, unreasonable post-arrest medical care, Rehabilitation Act violation, Americans with Disabilities Act violation, Bane Civil Rights Act violation, assault and battery, intentional infliction of emotional distress and negligence. She wants $5 million from the police department in payback. Ochoa is represented by the Law Office of Mark E. Merin of Sacramento.
