Engineering company sues Microsoft for $24 million

SAN JOSE - An engineering company is suing Microsoft for an alleged outstanding balance on an account for a plumbing and mechanical job. 

Acco Engineered Systems, Inc. filed a lawsuit on Dec. 22 in the Santa Clara County Superior Court against Microsoft Corporation, Baccarat Shoreline, LLC., Rudolph and Sletten, Inc., Quality Cabinet and Fixture Company, LLC., and Does 1-10 for money due on contract, foreclosure of mechanics lien, account stated, open book account, reasonable value of labor and materials furnished and quantum meruit. 

According to the lawsuit, on Aug. 17, 2021, Acco entered into a writer guaranteed maximum price contract with Rudolph and Sletten in which ACCO agreed to furnish labor, equipment and materials for the installation of a mechanical and plumbing system work known as "Microsoft Silicon Valley Campus" for the total of $24,351,815. Due to change orders, the price was then increased to $92,020,810, the suit says.

ACCO is seeking $24,351,815 it says hasn't been paid. ACCO is represented by Dustin Lozano of Hunt, Ortmann, Palffy, Nieves, Darling and Mah, Inc.
