In the Court of Appeal of the State of California, First Appellate District, Division Three, a case (A168081) was filed on March 19, 2024. The plaintiff and respondent is N.M., while the defendant and appellant is W.K. The lawsuit pertains to a domestic violence restraining order (DVRO) issued by the trial court to protect N.M. and her daughter from W.K.

The DVRO request was initially filed by N.M. on February 6, 2023, alleging multiple incidents of domestic abuse perpetrated by W.K. These incidents include physical assaults leading to unconsciousness and threats made in front of their two-year-old daughter, Nyla. Evidence submitted includes photographs of injuries sustained during an October 2022 incident and subsequent text messages between N.M. and W.K.

N.M.'s supplemental declaration detailed regular physical abuse that began shortly after their marriage in 2018. This included reckless driving with her as a passenger, death threats, slaps, punches, and demands for respect. A former neighbor also provided a declaration attesting to hearing arguments involving abusive language and sounds indicative of physical assault.

The plaintiff seeks affirmation of the DVRO against the defendant to ensure her safety and that of their child. She has provided substantial evidence in support of her allegations including photographs documenting physical injuries inflicted upon her by the defendant, as well as text messages corroborating these incidents.
