Man sues Blue and Gold Fleet for personal injury alleging negligence and unseaworthiness of vessel

In the Superior Court of California, County of San Francisco, a lawsuit was filed by plaintiff Christopher Allard against Blue and Gold Fleet and Does One through Ten on May 7, 2024. The case, identified as CGC-24-614437, alleges personal injury under the Jones Act, 46 U.S.C. §30104.

Marks from the Law Offices of Cavin & Marks, Allard claims that he sustained injuries to his right elbow during a docking operation on August 2, 2022. He was employed as a deckhand aboard the ferry 'Dorado' which is owned and operated by the defendants. During a docking operation the plaintiff was suffered injuries to his right elbow and other various injures, leaving the plaintiff susceptible to further injures in the future.

Allard alleges that his injuries were directly caused by the negligence of the defendants and their failure to provide a safe working environment. He also asserts that the vessel was unseaworthy due to poor maintenance of its equipment and crew.

The plaintiff seeks damages for physical and mental suffering resulting from his injuries which he believes will lead to permanent disability and loss of earning capacity. He also seeks compensation for lost earnings and other benefits due to his inability to attend his usual occupation following the incident.
