A merchant mariner is suing his employers for severe injuries sustained while working aboard a vessel. Hassan Mohamed filed the complaint on July 11, 2024, in the Superior Court of California, County of San Francisco, against Sunrise Operations LLC and Pasha Hawaii Holdings LLC.
The lawsuit stems from an incident on July 18, 2021, when Mohamed was ordered to manually lift a portside pilot ladder aboard the mv Horizon Enterprise. During this task, he suffered significant injuries to his right shoulder. Mohamed claims that both defendants failed to provide a safe working environment and adequate supervision, which led to his injury. The complaint asserts that these failures constitute negligence under the Jones Act and general maritime law.
Mohamed's legal filing outlines multiple allegations against the defendants. He argues that they were negligent in providing a safe workplace, competent supervision, and adequately trained co-workers. Additionally, he claims that the vessel was unseaworthy due to defective equipment and inadequate maintenance. "EMPLOYER negligently breached duties of care owed to plaintiff by failing to fulfill any or all those particular duties," states the complaint.
The plaintiff seeks compensatory damages for physical injuries, pain and suffering, loss of wages and earning power, medical treatment costs, and loss of life's pleasures. Furthermore, Mohamed requests prejudgment interest at the legal rate until the trial date. He also seeks Maintenance and Cure benefits accrued up to the trial date.
Representing Hassan Mohamed is Arnold I. Berschler from Berschler Associates PC. The case has been assigned Civil No.: CGC-24-616819 in front of Judge [Name].
