Plaintiffs Sue Hotel Chain Over Bedbug Infestation

A harrowing experience at a Sacramento hotel has led to a lawsuit filed by two guests who claim they suffered severe physical and emotional distress due to bedbug bites. On July 12, 2024, the Law Offices of Ilan N. Rosen Janfaza, A.P.C., filed a complaint in the Superior Court of California for the County of Sacramento against Wyndham Destinations, Inc., Wyndham Worldwide Corporation, Khanna Enterprises - II, Limited Partnership, Wyndham Sacramento, and Ravi Khanna.

According to the complaint, plaintiffs Kevin Collopy and Hui Zhen Collopy checked into the Wyndham Sacramento on July 16, 2022. The next morning, they awoke with significant itching and discovered numerous bedbugs crawling on their bed. Despite reporting the infestation to the front desk staff and being offered a room change, the plaintiffs chose to leave the hotel immediately. They later sought medical treatment for their injuries and were diagnosed with bedbug bites.

The plaintiffs allege that the defendants had prior knowledge of bedbug infestations in their hotel but failed to take adequate measures to eradicate them or warn guests. "Defendants deliberately chose not to inspect or otherwise ensure that Plaintiffs’ room was free of Cimex lectularius (‘bedbugs’) immediately before Plaintiffs’ stay at the hotel," states the complaint. The plaintiffs argue that this negligence resulted in physical scarring, emotional distress including anxiety and insomnia, and various financial costs such as medical expenses and replacement of infested belongings.

The lawsuit accuses the defendants of multiple legal violations including battery, negligence, intentional infliction of emotional distress, fraudulent concealment, private nuisance, public nuisance, and breach of contract. The plaintiffs seek general and specific damages for their suffering as well as punitive damages to punish what they describe as "extreme indifference" by hotel management towards guest safety.
