Tenant Alleges Negligence Against Real Estate Company Following Three-Story Fall

A shocking incident has led to a legal battle as a San Francisco resident accuses a local realty company of negligence and premises liability following a life-threatening accident. On July 26, 2024, Vivek Vaidya filed a complaint in the Superior Court of California, County of San Francisco, against De Wolf Realty Co., alleging severe injuries due to unsafe conditions at his rented apartment.

Vivek Vaidya, represented by attorneys Tanya Gomerman and Alexander Aronov from Gomerman | Bourn & Associates, claims that he suffered significant injuries after falling three stories from his apartment window at 733 Cole Street on April 28, 2024. According to the complaint (Case No.: CGC-24-616794), Vaidya had signed a 12-month lease with De Wolf Realty Co. on March 14, 2024, for Unit #5 at the monthly rent of $2,995. Just over a month into his tenancy, while watching the sunset from his apartment window, the glass shattered unexpectedly, causing him to plummet to the ground below.

The complaint details that Vaidya struck an exterior gas line during his fall before hitting the ground violently. He alleges that De Wolf Realty Co., which owns and manages multiple units at the location including Unit #5, had previously conducted repairs on the windows but failed to ensure their safety. "As a result of the acts and/or omissions of the defendants," Vaidya's filing states, "Plaintiff fell three stories due to the negligently maintained window causing him to sustain injuries and damages."

Vaidya's lawsuit accuses De Wolf Realty Co. and unnamed defendants (Does 1 through 100) of failing in their duty to maintain safe premises. The filing asserts that these parties "negligently and carelessly owned, leased, rented, occupied, possessed, designed... inspected... controlled" the property in question. It further claims that they did not provide adequate warnings about potential dangers or take necessary steps to prevent such hazardous conditions.

The plaintiff is seeking general damages for physical pain and suffering caused by permanent disabilities resulting from his fall. Additionally, he demands compensation for medical expenses already incurred and those anticipated in the future due to ongoing treatment needs. The suit also requests damages for loss of earning capacity owing to his injuries and seeks prejudgment interest along with coverage for legal costs.
