H Mart San Francisco, LLC has filed a lawsuit accusing a trucking company of negligence that resulted in significant property damage. The complaint was lodged by H Mart San Francisco, LLC on April 23, 2025, in the Superior Court of California, County of San Francisco against Brandon Trucking Company and Carlos Rivera.
The plaintiff, H Mart San Francisco, LLC, operates a supermarket at 3995 Alemany Boulevard in San Francisco. They allege that on June 13 and June 23 of 2022, a truck owned or operated by Brandon Trucking Company and Carlos Rivera negligently reversed into the supermarket's loading dock rolling gate twice. This incident reportedly caused severe damage to the gate and its related equipment and structure. The complaint claims that despite repeated demands for repair from the defendants, they refused to address the damages. Consequently, H Mart had to undertake repairs themselves at a cost of approximately $80,419.84.
The plaintiff further alleges that Carlos Rivera is personally liable under an alter ego theory because he allegedly used Brandon Trucking Company as a mere shell to evade obligations. The complaint accuses Rivera of failing to fulfill corporate formalities and conducting business without sufficient capital or assets necessary to meet liabilities. These actions are said to have left Brandon Trucking Company unable to cover incurred debts, including those owed to H Mart.
In response to these events, H Mart is seeking compensatory damages not less than $80,419.84 along with costs of suit and any other relief deemed proper by the court. They assert that the defendants' negligence was a substantial factor in causing the damages they suffered.
