San Francisco Resident Sues Motorist Over Negligent Operation Leading to Severe Injuries

A motor vehicle accident in San Francisco has led to a legal battle as a resident files a lawsuit for damages. On July 25, 2024, Qiuer Wu filed a complaint in the Superior Court of California, County of San Francisco, against Jacquez Donaldson. The case revolves around an incident that occurred on April 5, 2023.

According to the complaint, Wu was driving her Toyota RAV-4 eastbound on Paul Avenue when she had to stop due to traffic ahead. At this moment, Donaldson, who was driving a Chevy Malibu behind her, failed to stop and collided into the rear of Wu's vehicle at high speed. This collision resulted in serious and permanent injuries for Wu. She alleges that Donaldson was negligent in his operation of the motor vehicle by failing to observe traffic conditions and maintain a safe distance from other motorists.

Wu's complaint details how Donaldson breached his duty of care as a reasonably safe and prudent motorist. "Defendant Donaldson’s negligence proximately caused Plaintiff to suffer physical injuries to her body, pain and suffering, mental anguish and severe emotional distress," the document states. It further elaborates that Wu has incurred past medical expenses and anticipates additional costs for future medical treatment. Additionally, she claims loss of earnings and earning capacity due to the injuries sustained from the accident.

The plaintiff is seeking several forms of relief from the court. Firstly, she requests a judicial determination that the defendants were legally responsible for her injuries and damages. This includes compensation for all incurred damages such as past and future medical costs, pain and suffering, loss of earnings, and diminished earning capacity. Furthermore, Wu seeks recovery against the defendants for litigation costs and other related expenses.
