Bicyclist Sues Tesla Driver for Negligence After Severe Accident

A severe bicycle accident involving a Tesla Model Y has led to a lawsuit alleging negligence and loss of consortium. The complaint was filed by Catherine Schmidt and Carter Rainer in the Superior Court of California, County of San Francisco, on August 5, 2024, against Melanie Ana Edwards.

According to the court documents, the plaintiffs allege that on July 16, 2024, at approximately 7:36 a.m., Catherine Schmidt was lawfully riding her bicycle on northbound Nancy Pelosi Drive in San Francisco when she collided with a gray 2024 Tesla Model Y. The vehicle was allegedly driven negligently by Melanie Ana Edwards and other unnamed defendants. The collision resulted in Schmidt sustaining severe injuries including a traumatic brain injury, facial lacerations, a rotator cuff tear, and other undiagnosed injuries. "By reason of the premises," the complaint states, "Plaintiff Catherine Schmidt sustained traumatic brain injury," among other injuries which are believed to be permanent.

The plaintiffs argue that Edwards and the unnamed defendants were negligent in their operation and maintenance of the vehicle. They claim that all defendants were acting within their roles as agents or employees at the time of the incident. The complaint further alleges that due to these injuries, Schmidt has incurred significant medical expenses and will continue to do so as her treatment is ongoing. Additionally, her ability to work has been compromised, leading to economic losses which are yet to be fully determined.

Carter Rainer also seeks damages for loss of consortium due to his wife’s injuries. He claims that he has suffered from a loss of support, services, companionship, and society because of Schmidt's condition. "By reason of the negligence of Defendants as stated above," Rainer alleges he experienced a significant impact on his marital relationship.

The plaintiffs are seeking general damages beyond the jurisdictional minimums set by the court along with medical expenses and other economic losses according to proof at trial. They also seek pre-judgment statutory interest and any further relief deemed just by the court.
