Cecilia Robledo has filed a class action lawsuit against her former employer, a California-based skilled care facility, alleging numerous violations of the California Labor Code. The complaint was lodged in the Superior Court of California for the County of Santa Clara on September 30, 2024, targeting Reedley Skilled Care LLC and unnamed defendants referred to as DOES 1 through 10.
The lawsuit accuses Reedley Skilled Care LLC of several labor violations including failure to pay minimum and overtime wages, failure to provide meal and rest periods, and not issuing accurate wage statements. According to Robledo, these practices have been ongoing throughout her employment from November 2015 to the present. She claims that the company willfully failed to compensate employees for all hours worked, did not authorize proper breaks as required by law, and often manipulated time records to avoid paying for off-the-clock work. "Defendants have obtained valuable property, money and services from Plaintiff," states the complaint, emphasizing the detrimental impact on Robledo and her colleagues.
Robledo is seeking restitution for unpaid wages along with penalties and interest. The lawsuit also demands that Reedley Skilled Care LLC be enjoined from continuing these alleged unlawful practices. Furthermore, Robledo requests class certification for others similarly affected by these practices during their employment at Reedley Skilled Care LLC. The complaint outlines nine causes of action ranging from unfair business practices under California Business & Professions Code §§ 17200 et seq., to failing to indemnify employees for necessary expenditures under Labor Code § 2802.
