Former Employees Accuse Togo's Eateries LLC of Labor Violations

Breanna Vinson and Roseanne Beam have filed a class-action lawsuit against a well-known sandwich chain, alleging multiple violations of California labor laws. The complaint was filed on September 23, 2024, in the Superior Court of California for the County of Santa Clara against Togo’s Eateries, LLC, Valley Togo Inc., and Togo’s Sandwiches.

The plaintiffs claim that the defendants failed to pay minimum and overtime wages, did not provide legally required meal and rest breaks, and neglected to issue accurate wage statements. They allege that these practices are part of a systematic policy by the defendants to cut costs at the expense of their employees' rights. Breanna Vinson worked for the defendants from August 2016 to September 2023, while Roseanne Beam was employed from January 2021 to November 2023. Both plaintiffs were hourly-paid, non-exempt employees who often worked more than eight hours a day or forty hours a week without receiving appropriate compensation. The lawsuit states that "Defendants maintained a systematic, company-wide policy" that violated several sections of the California Labor Code and Business & Professions Code.

In addition to seeking unpaid wages and damages for themselves and other similarly situated employees, Vinson and Beam are pursuing civil penalties under the Private Attorneys General Act (PAGA) on behalf of aggrieved employees in California. The plaintiffs argue that they have been deprived of their rights due to the defendants' unlawful business practices. They are asking for various forms of relief including unpaid wages, statutory penalties, injunctive relief to prevent further violations, and attorney's fees.
