Plaintiff alleges driver negligence after pedestrian accident involving Lexus

Katherine C. Babcock has filed a lawsuit alleging negligence after being struck by a vehicle while crossing a street in San Francisco. The complaint was filed on September 24, 2024, in the Superior Court of California, County of San Francisco, against John S. Paige and several unnamed defendants.

The incident occurred on December 29, 2022, when Babcock was using the southern crosswalk at the intersection of Divisadero Street and Francisco Avenue. According to the complaint, Paige and other unnamed defendants were responsible for owning, controlling, maintaining, and operating a Lexus automobile that collided with Babcock as they attempted to make a left turn onto southbound Divisadero Street. The plaintiff claims that the defendants' careless and negligent actions directly resulted in her sustaining serious personal injuries.

Babcock's legal representation from Abramson Smith Waldsmith LLP argues that due to the negligence of Paige and the other defendants, she has endured extensive pain and suffering along with non-economic damages. The complaint further states that Babcock has incurred significant medical expenses for services such as hospitalization, x-rays, medicines, and medical supplies as a result of her injuries. It is anticipated that these expenses will continue to accumulate in the future.

Additionally, Babcock asserts that she has suffered a loss of earnings and earning capacity due to her injuries. Although the exact monetary value of these losses is not currently known, she seeks compensation for them once they are determined. The plaintiff also requests interest as provided by law on these damages.

In seeking relief from the court, Katherine C. Babcock requests judgment against all defendants for both non-economic damages related to her pain and suffering and economic damages including medical costs and lost wages. She also seeks reimbursement for legal costs incurred during this suit and any additional relief deemed appropriate by the court.
