Construction Worker Alleges Wage Violations Against Former Employer J.B.&B.Construction

A construction company is facing serious allegations of labor law violations in California. Jose Manuel Martinez Gomez filed a class action complaint against J.B. & B. Construction, Inc., on October 8, 2024, in the Superior Court of California, County of Santa Clara. The lawsuit accuses the company of multiple violations of the California Labor Code and unfair business practices.

The complaint, brought forth by Gomez individually and on behalf of other similarly situated employees, alleges that J.B. & B. Construction failed to pay overtime compensation, provide meal and rest periods, pay minimum wages, issue accurate wage statements, reimburse necessary business expenses, and more. "Defendant engaged in an ongoing and systematic scheme of wage abuse against their hourly-paid or non-exempt employees," states the lawsuit. The plaintiff claims that these actions violate several sections of the California Labor Code including §§ 510 and 1198 for unpaid overtime and §§ 226.7 and 512(a) for unpaid meal period premiums.

Gomez worked as a construction worker for J.B. & B. Construction from June 2014 to March 2024. Throughout this period, he alleges that the company regularly required him and other class members to work off-the-clock without compensation and failed to provide legally compliant meal periods or rest breaks. Furthermore, the complaint highlights that the company did not reimburse employees for necessary business-related expenses such as clothing, bridge tolls, fuel costs for work-related travel among others.

The plaintiffs are seeking various forms of relief from the court including certification of the class action lawsuit, appointment as class representative for Gomez, restitution for unpaid wages with interest, statutory penalties under different sections of the California Labor Code, attorneys' fees and costs incurred during litigation. They also demand injunctive relief to ensure compliance with state labor laws moving forward.
