The case centers around an incident involving Hilary "Morgan" Roller, an employee of the City of Brisbane, who sustained injuries due to alleged unsafe conditions at a property managed by Kahn and Keville.
According to the complaint, on April 18th, 2023, Hilary "Morgan" Roller was performing her duties as an employee of the City of Brisbane when she slipped and fell at premises located at 445 Grand Ave, South San Francisco. The plaintiff alleges that Kahn and Keville, Inc., along with unnamed defendants referred to as DOES 1 through 50, failed in their duty to maintain safe conditions on the property. The complaint asserts that these parties were responsible for managing and supervising the premises and had knowledge of dangerous conditions but did not take appropriate actions to remedy them or warn those present.
The City of Brisbane claims it is entitled to file this suit under California Labor Code § 3852 because it has paid workers' compensation benefits to Roller due to her injuries. The lawsuit seeks compensatory damages for these benefits as well as personal injury damages suffered by Roller. It accuses Kahn and Keville, Inc., and associated parties of negligence that resulted in Roller's physical injuries and subsequent financial losses due to her inability to work.
