Former Employee Alleges Wage Violations Against Real Estate Company

Jason Frey has filed a class action lawsuit against The Salwasser Group, Inc., alleging numerous violations of California labor laws. The complaint was submitted on October 25, 2024, in the Superior Court of California for the County of Santa Clara. Frey claims that the real estate company failed to pay all due overtime wages, violated meal and rest period regulations, and neglected to reimburse necessary business expenses among other infractions.

The plaintiff, Jason Frey, who worked as a Maintenance Technician for The Salwasser Group from April 2022 until October 3, 2024, accuses his former employer of failing to properly calculate overtime wages by not including all forms of compensation such as bonuses and commissions in the regular rate of pay. He also alleges that the company did not provide accurate wage statements or timely final wages upon employment termination. Furthermore, Frey asserts that employees were denied legally compliant meal and rest periods and were not compensated with premium wages when these breaks were missed or interrupted.

Frey's lawsuit seeks to address these grievances through a class action representing all similarly situated non-exempt employees who have worked for The Salwasser Group over the past four years. The legal filing cites multiple sections of the California Labor Code and Business and Professions Code as having been violated by the defendant's practices. Specifically, it references violations related to unpaid overtime (Labor Code §§ 204, 210, 510), failure to provide meal and rest periods (Labor Code §§ 226.7, 512), inaccurate wage statements (Labor Code § 226(a)), waiting time penalties (Labor Code §§ 201-203), and failure to reimburse business expenses (Labor Code § 2802).

The plaintiff is seeking compensatory damages for unpaid wages and benefits owed under California law. Additionally, he demands restitution for unfair competition practices under Business and Professions Code § 17200 et seq., statutory penalties for wage statement violations, waiting time penalties for delayed final payments upon termination, reimbursement for business expenses incurred during employment without proper compensation from the employer, prejudgment interest on unpaid wages pursuant to Civil Code §§ 3287 and 3289; attorneys' fees; costs associated with bringing this action forward; as well as any other relief deemed just by the court.
