Patient Alleges Negligence Against Palo Alto Medical Foundation in Malpractice Suit

A medical malpractice lawsuit has been filed, bringing to light serious allegations against a well-known healthcare provider. James Derbin initiated the complaint on November 15, 2024, in the Superior Court of California, County of Santa Clara, targeting Akira Yamamoto, MD; Lynette Tschabold, PA-C; Scott Morley, PT; and several entities under the Palo Alto Medical Foundation umbrella.

The lawsuit stems from a medical procedure that took place on December 7, 2023. On this date, Derbin underwent a left total hip arthroplasty performed by Dr. Yamamoto at the Palo Alto Medical Foundation Ambulatory Surgery Center. According to the complaint, Dr. Yamamoto's performance fell below the applicable standard of care. It is alleged that not only was the surgery itself negligent but subsequent care by other defendants also failed to meet professional standards. Specifically, it is claimed that there was a failure to properly inspect and diagnose a dislocation in Derbin's left hip until late December 2023—an oversight described as "very likely dislocated for almost the entire postoperative period."

Derbin's complaint details ongoing medical complications resulting from this negligence, necessitating further medical attention and treatment. The plaintiff accuses all involved parties of failing to exercise reasonable care and skill expected of healthcare professionals. This alleged negligence resulted in significant physical and mental suffering for Derbin, with claims of permanent disability.

In seeking justice through this legal action, Derbin requests compensation exceeding $25,000. He demands general damages beyond the court's minimum jurisdictional limits for his injuries and suffering. Additionally, he seeks reimbursement for past and future medical expenses incurred due to this incident and compensation for lost wages both retrospectively and prospectively due to his inability to work.
