Residents Sue Tenants Over Alleged Harassment at San Francisco Property

In a gripping legal battle unfolding in San Francisco, two residents have taken a stand against what they describe as relentless harassment by their neighbors. On May 7, 2025, Linda Harrington and Mercedes Ladao filed a complaint in the Superior Court of California for the County of San Francisco against Alejandra Garcia and Michael Luchi. The plaintiffs allege a campaign of intimidation and abuse that has disrupted their lives.

Linda Harrington, the owner of a residential building at 762 Hayes Street, along with resident Mercedes Ladao, accuse tenants Alejandra Garcia and her husband Michael Luchi of engaging in harassing behavior that includes noise disturbances, derogatory communications, and frivolous legal actions. According to the complaint, this behavior is part of a coordinated effort to create an intolerable living environment. The plaintiffs argue that these actions have caused them severe emotional distress and psychological harm. They claim that Defendant Garcia's attempts to secure Temporary Restraining Orders (TROs) against them were dismissed for lack of merit, while Harrington successfully obtained an Elder Abuse Restraining Order against Garcia.

The plaintiffs are seeking various forms of relief from the court. They demand general and special damages to be determined at trial, punitive damages for malicious conduct, statutory damages under specific California codes related to elder abuse and harassment, as well as attorney’s fees. Additionally, they seek permanent injunctive relief to prevent further harassment by the defendants. The lawsuit outlines multiple causes of action including harassment under Civil Code § 527.6, intentional infliction of emotional distress, abuse of process due to misuse of legal proceedings by the defendants, elder abuse under Welfare & Institutions Code § 15657 for Harrington who is over 65 years old, negligent infliction of emotional distress due to breach of duty by the defendants, and civil conspiracy between Garcia and Luchi.
